Licensing

Licensing by state

Registration is national, not state-based. You register once as a registered nurse with the Nursing and Midwifery Board of Australia through Ahpra, and it is recognised in every state and territory with no separate state licence for perioperative work. There is no NMBA endorsement specific to theatre nursing — competence is credentialled by the employer against ACORN standards. What varies by jurisdiction is the employer (each state's public health system, or a private hospital or day surgery group, where a large share of elective surgery happens), the industrial instrument (state nursing enterprise agreements in public theatres, the federal Nurses Award 2020 or a facility agreement in private), the state drugs and poisons legislation controlling schedule 8 and schedule 4 drug handling in anaesthetics and recovery, radiation safety licensing where nurses operate or assist with image intensifiers, and state screening checks including police checks, immunisation and working-with-children or vulnerable-people registration.

the Australian Capital Territory

Canberra Health Services operates the territory's public theatres and day surgery under the ACT Public Sector Nursing and Midwifery Enterprise Agreement, with private theatre work at Calvary and National Capital Private. Drug handling follows the Medicines, Poisons and Therapeutic Goods Act 2008 (ACT), and Working with Vulnerable People (WWVP) registration is required for clinical roles.

New South Wales

NSW Local Health Districts employ public theatre nurses under the Public Health System Nurses' and Midwives' (State) Award. Schedule 8 handling follows the Poisons and Therapeutic Goods Act 1966 (NSW) and Regulation, and radiation use is regulated under the Radiation Control Act 1990 (NSW). NSW Health requires Category A vaccination compliance, and a Working With Children Check for child-related lists.

the Northern Territory

NT Health operates theatres at Royal Darwin, Palmerston, Alice Springs, Katherine and Tennant Creek hospitals, with nurses under the Northern Territory Public Sector Nurses and Midwives' Enterprise Agreement. Drug handling follows the Medicines, Poisons and Therapeutic Goods Act 2012 (NT). Small teams, broad scope, visiting specialist surgical outreach lists and cultural safety practice with Aboriginal patients are defining features; an Ochre Card is required for paediatric work.

Queensland

Queensland Health Hospital and Health Services run public theatres under the Nurses and Midwives (Queensland Health and Department of Education) Certified Agreement; private hospital and day surgery theatres use the Nurses Award 2020 or a facility agreement. Controlled drug handling in anaesthetics follows the Medicines and Poisons Act 2019 (Qld). Radiation use in theatre is licensed under the Radiation Safety Act 1999 (Qld). A Blue Card applies where paediatric lists are involved.

South Australia

SA Health Local Health Networks employ theatre nurses under the Nursing/Midwifery (South Australian Public Sector) Enterprise Agreement. Controlled substances follow the Controlled Substances Act 1984 (SA) and radiation use the Radiation Protection and Control Act 2021 (SA). DHS screening checks apply according to the patient group.

Tasmania

The Department of Health Tasmania runs public theatres under the Nurses and Midwives (Tasmanian State Service) Award and Agreement. Drug handling follows the Poisons Act 1971 (Tas). Registration to Work with Vulnerable People (RWVP) is required. Smaller theatre complexes mean nurses commonly rotate across scrub, scout, anaesthetics and recovery rather than sub-specialising.

Victoria

Victorian public health services employ perioperative nurses under the Nurses and Midwives (Victorian Public Sector) (Single Interest Employers) Enterprise Agreement, with Victoria's legislated ratios applying to recovery areas under the Safe Patient Care Act 2015. Drug handling follows the Drugs, Poisons and Controlled Substances Act 1981 (Vic) and radiation use the Radiation Act 2005 (Vic). A Working with Children Check is required for paediatric work.

Western Australia

WA Health Service Providers employ public theatre nurses under a WA state industrial agreement; Perth's large private hospital sector uses the Nurses Award 2020 or facility agreements. Anaesthetic drug handling sits under the Medicines and Poisons Act 2014 (WA) and radiation use under the Radiation Safety Act 1975 (WA). Regional theatres within the WA Country Health Service run smaller multi-skilled teams. A Working with Children Check (WA) applies where relevant.
