The Miscellaneous Award 2020 (MA000104) is the modern award that sets minimum pay and conditions for employees who are not covered by any other modern award and who are not the kind of employee traditionally regarded as award-free. It is the catch-all safety net of the award system: rather than describing one industry, it exists so workers do not fall through the gaps when no industry or occupational award fits their role. If you employ someone and cannot identify a specific award that covers them, the Miscellaneous Award is often the instrument that applies, so it deserves a deliberate check rather than an assumption that no award applies.

How pay is structured

MA000104 sets minimum rates through a small set of classification levels defined by the skills, training and responsibility a role requires, rather than by industry-specific duties, since the award is designed to apply across many kinds of work. You place each employee at the level that matches the work they genuinely perform, then pay at least that minimum. The award also provides junior percentage rates for employees under 21 and apprentice provisions where relevant. Those minimums are reviewed each year and rise from the first full pay period on or after 1 July; the 2026 review added 4.75% to modern award minimums. Because the award covers such a broad range of roles, take particular care to match the classification correctly, and always confirm the current rate against the Fair Work Pay Calculator rather than relying on a remembered figure.

Penalties & loadings

Even as a catch-all, MA000104 provides the standard safety-net penalties and loadings. Weekend work attracts penalties (as a general guide across awards, Saturday is commonly around 25% and Sunday around 50%), and public holiday work is paid at a substantial premium that can reach up to 150%. Overtime applies for hours beyond the ordinary hours set by the award, paid at penalty rates. Casual employees receive a loading on top of the minimum, commonly 25% across modern awards. The award provides a more limited set of allowances than industry-specific awards, but standard entitlements such as meal allowances for qualifying overtime can apply. Annual leave loading is 17.5%. The Miscellaneous Award is designed to catch exactly those workers, unless they are genuinely the kind of employee traditionally regarded as award-free. Test coverage properly before treating anyone as award-free, and confirm the position against the Fair Work source.

Defaulting to this award when a specific award actually applies

The flip side is using the Miscellaneous Award as a convenient default when a more specific industry or occupational award genuinely covers the role. Other awards take precedence wherever they apply, and paying under the wrong award can mean missing entitlements that the correct award provides. Identify whether any specific award fits first, and only fall back to MA000104 when none does.

Misclassifying across a broad role mix

Because this award spans many kinds of work, placing employees at the right level is harder than in a single-industry award. The classification turns on the skills, training and responsibility of the role, not an industry job title. Guessing the level, or putting everyone at the lowest band, is a common source of underpayment; use the award's classification definitions to assign each role.

Paying a flat rate to under-21 juniors

MA000104 sets junior percentage rates for employees under 21, scaled to age, on top of its small classification structure. Because these workers are often an overlooked corner of a workforce, employers commonly pay a single flat junior or adult rate and forget to step the percentage up on each birthday.
