What the Post-Secondary Education Award covers

The Educational Services (Post-Secondary Education) Award 2020 (MA000075) is the modern award covering employers and employees in the post-secondary education industry in Australia. It applies to settings such as private colleges, vocational education and training (VET) providers, English-language colleges (ELICOS) and similar non-school, non-university post-secondary providers, but not secondary schools or universities. Because it runs separate streams for academic teachers, teachers and tutor/instructors, and general staff, and layers shift, weekend, public holiday and overtime provisions on top of the minimum rates, it takes care to pay correctly.

How pay is structured

MA000075 sets minimum rates against three main classification streams: academic teachers (graded across Levels A, B and C); teachers and tutor/instructors (graded across a numbered ladder of levels); and general staff (graded across numbered levels reflecting skill and responsibility). Each stream and level reflects different qualifications, autonomy and duties, so the first task is classifying each worker against the stream and level that matches the work they actually do. Full-time staff work 38 ordinary hours a week, part-timers work a smaller, reasonably predictable number of hours, and casuals are paid by the hour with a minimum engagement. The award also provides for sessional engagement of teaching staff for defined periods. The current minimum weekly and hourly rate for each classification should always be taken from the Fair Work Pay Calculator or the award's pay guide, as they change with each Annual Wage Review. Minimum rates rise from the first full pay period on or after 1 July each year; the 2026 review added 4.75% to modern award minimums.

Penalties & loadings

On top of the minimum rate, MA000075 layers weekend penalties, public holiday rates, shift penalties and overtime, and it carries a distinctive set of allowances. Named allowances in the award include a first aid allowance, a clothing and footwear (and laundry) allowance, a meal allowance for general staff working unscheduled overtime, a living-away-from-home allowance, travel time and fares, transport for shiftworkers, and a per-kilometre vehicle allowance. Casual employees receive a casual loading in place of paid leave, and shiftworkers receive shift penalties for afternoon, night and weekend ordinary hours. As a general guide across awards, casual loading is commonly 25%, weekend penalties commonly run around 25% on Saturday and 50% on Sunday, public holidays can reach up to 150%, and annual leave loading is 17.5% - but the exact figure for each penalty, loading and allowance must always be confirmed against the Fair Work source for this award.

Common Post-Secondary Education Award compliance traps

Putting staff in the wrong stream or level

MA000075 has three distinct streams - academic teachers (Levels A to C), teachers and tutor/instructors, and general staff - each with its own rates and ladder. Paying a teacher on a general-staff rate, or failing to progress staff as their qualifications and responsibilities grow, creates underpayments that compound over time.

Mishandling sessional and casual teaching engagements

Teaching staff can be engaged sessionally or as casuals, with different rules for minimum engagement and how a session or hour is paid. Treating a sessional or casual teacher the same as a salaried full-timer, or missing the casual loading, is a common and costly error.

Overlooking shift, weekend and overtime loadings

Where ordinary hours fall on an afternoon, night or weekend, or where hours run beyond the ordinary span, the award applies shift penalties, weekend penalties and overtime rates on top of the base rate. These are easy to leave off when staff teach outside standard daytime hours.

Overlooking the general-staff and shiftworker allowances

MA000075 carries allowances that sit outside the headline rates: a meal allowance for general staff working unscheduled overtime, a transport allowance for shiftworkers, travel time and fares, and a living-away-from-home allowance. Because these are paid per shift, per day or per occurrence, they are easy to leave off for support staff working late or travelling between campuses. Identify which apply to each role and pay them on top of the base rate.
