The Labour Market Assistance Industry Award 2020 (MA000099) is the modern award that sets minimum pay and conditions for employers and employees in the labour market assistance industry across Australia. This is the sector that helps people into work and supports them once there - employment services, job placement, vocational and disability employment support, and related case management and training. If you run an organisation delivering these services and employ staff in the award's classifications, this is generally the instrument you apply, to the exclusion of other awards. How pay is structured
MA000099 sets minimum rates through a structure of classification levels defined in the award's classification schedule, with each level reflecting the skills, autonomy and responsibilities a role requires - from entry-level support roles up to experienced case managers and coordinators. You assign each employee to the level matching the work they actually perform, then pay at least that minimum. Full-time, part-time and casual engagement all apply, and the award also contemplates trainees and on-hire arrangements. Minimum rates are reviewed each year in the Annual Wage Review and increase from the first full pay period on or after 1 July; the 2026 review added 4.75% to modern award minimums. Penalties & loadings
On top of the minimum rate, MA000099 carries penalties for weekend and certain other hours, overtime, casual loading and a set of allowances. Weekend ordinary hours attract penalties (as a guide across awards, commonly around 25% on Saturday and 50% on Sunday), and public holiday work can reach up to 150%. Overtime is paid at penalty rates once ordinary hours are exceeded. Casuals receive a loading on the minimum, commonly 25% as a guide. The award provides allowances suited to the sector, which can include a vehicle allowance for work-related travel between clients and sites, a meal allowance on qualifying overtime, and a first aid allowance. The award's levels reflect increasing skill, autonomy and responsibility, so an experienced case manager or coordinator sits well above an entry-level support role. Defaulting staff to a single rate, or not moving someone up as their responsibilities grow, underpays them. Use the classification definitions to place each role at the level that matches the work actually performed.
Overlooking the vehicle and travel allowance
Staff in this sector often travel between clients, employers and outreach sites, and the award can provide a vehicle allowance for using a private car for work. Reimbursing fuel only, or nothing at all, can fall short of what the award requires. Identify which staff qualify for the vehicle or travel provisions and confirm the current rate on the Fair Work source.
Letting funding cycles delay the wage obligation
Award minimums rise from the first full pay period on or after 1 July regardless of when program funding is renewed, so the wage obligation can move before the funding does. Holding staff on last cycle's rates because a contract has not been refreshed, or budgeting only to the old figure, breaches the award. Treat any funding gap as a budgeting issue, apply the new rates from the correct pay period, and confirm them via Fair Work.
