What the State Government Agencies Award covers

The State Government Agencies Award 2020 (MA000121) is the modern award that sets minimum pay and conditions for certain employees of state and territory government agencies and authorities that fall within the national workplace relations system. It applies to administrative, clerical, technical, professional and operational staff working for the bodies it covers, where those employees are not covered by a state industrial instrument or another modern award. Because most state public sector employees are covered by state awards or enterprise agreements, the reach of this award is narrower than its name suggests, and coverage needs to be checked carefully for each agency.

How pay is structured

MA000121 sets minimum rates through classification levels that step up with the skill, qualifications, judgement and responsibility a role requires, with the detailed descriptors set out in the award's classification schedule. You assign each employee to the level that matches the duties they actually perform, then pay at least that level's minimum. Casual employees are paid by the hour with a loading in place of permanent entitlements. Minimum rates are reviewed each year in the Fair Work Commission's Annual Wage Review and increase from the first full pay period on or after 1 July; the 2026 review added 4.75% to modern award minimums. Many state agencies pay above the award under an enterprise agreement, but the award still sets the safety-net floor, so confirm the current minimum for any classification on the Fair Work Pay Calculator.

Penalties & loadings

The award provides penalties and loadings for work outside ordinary hours. Where agency work falls on weekends, Saturday and Sunday ordinary hours attract penalty loadings (commonly around 25% for Saturday and around 50% for Sunday as a guide), and public holiday work is paid at a premium that can reach up to 150%. Shift work, where it applies, attracts shift loadings that vary with when the shift falls. Overtime is paid at penalty rates once an employee works beyond ordinary hours, stepping up after the initial period. Casual loading is commonly 25%. The award also provides for relevant allowances tied to particular duties or conditions, and annual leave loading is 17.5%. Common State Government Agencies Award compliance traps

Assuming the award applies when a state instrument actually governs

Most state public sector employees are covered by a state award or enterprise agreement rather than MA000121, and only national system employers fall within the federal scheme. Applying this award to staff who are governed by a state instrument, or vice versa, produces the wrong pay and conditions. Confirm which instrument actually covers each agency and cohort before relying on the award.

Underclassifying professional and technical staff

Administrative, technical and professional roles must sit at the classification level that reflects their real responsibilities, judgement and qualifications, not a default band. Underclassifying a professional officer or a senior administrator understates their minimum entitlement. Use the award's classification descriptors to place each role accurately and review the level as duties grow.

Letting an enterprise agreement mask the award floor

Where an enterprise agreement applies, it must leave employees better off overall than the award. If an agreement lapses, or a particular term falls short, the award's minimum rates, penalties and entitlements remain the safety net. Treating the agreement as the only reference, and never checking it against the current award floor, is a compliance risk.

Flattening shift loadings that stack with penalties

Where agency staff work shifts, the award sets afternoon and night shift loadings that vary with when the shift falls and can combine with weekend or public holiday penalties on shifts spanning those periods. Paying a single shift figure, or treating shift work like ordinary daytime hours, understates what is owed. Map each shift's timing and day and apply the correct loading on top of any penalty, confirmed against the Fair Work source.
