The Cemetery Industry Award 2020 (MA000070) is the modern award that sets minimum pay and conditions for employees in the cemetery and crematorium industry across Australia. It covers the operational, grounds, interment and crematorium roles that keep these sites running, organised into six Cemetery Employee classifications plus apprentices and juniors. How pay is structured

Minimum wages are built around a six-level Cemetery Employee classification structure (Class 1 through Class 6), with Schedule A of the award defining the duties, skill and responsibility that place an employee at each level. Class 1 is entry-level and Class 6 the most senior; juniors and apprentices are paid a percentage of the relevant rate. You classify each employee against the Schedule A descriptions, then read the matching weekly and hourly minimum from the Fair Work source. These minimums increase from the first full pay period on or after 1 July each year following the Annual Wage Review; the 2026 review added 4.75% to modern award minimums, so always confirm the current rate on the Fair Work Pay Calculator rather than carrying last year's figure forward.

Penalties & loadings

Ordinary hours under this award are worked between 7.00am and 6.00pm Monday to Friday, so there are no weekend ordinary-hours penalties; instead, weekend work is generally paid as overtime. Casuals receive a loading commonly set at 25% in place of leave entitlements, with a minimum engagement, and overtime and public holiday work attract higher rates (public holidays carry a substantial penalty plus a minimum payment). The award also carries an annual leave loading of 17.5%. On top of these, it has a distinctive set of allowances: an industry allowance, leading hand allowances, a first aid allowance, expense items such as meal and vehicle (per kilometre) allowances, and task-based payments unique to the sector for exhumation (per body), lifting and deepening graves, and excavation. Common Cemetery Industry Award compliance traps

Treating weekend work as a simple weekend penalty

Ordinary hours run 7.00am to 6.00pm Monday to Friday only, so Saturday and Sunday work is generally overtime rather than a flat weekend loading. Applying a standard weekend penalty instead of the correct overtime rate can systematically underpay staff.

Missing the sector-specific task allowances

Exhumation (paid per body and varying with how long the burial has been in place), lift-and-deepen, and excavation allowances are easy to overlook because they do not appear in most other awards. Each qualifying task should trigger the matching allowance at the current Fair Work amount.

Misclassifying employees across the six Class levels

Pay flows from the Schedule A classification, so placing someone in the wrong Class (or leaving them on entry-level rates after their duties grow) creates ongoing underpayment. Review duties against the Schedule A definitions whenever a role changes.

Paying apprentices and juniors the full adult rate

Apprentices and junior employees are paid a percentage of the relevant adult Cemetery Employee rate, not the full Class rate. Defaulting them to the adult figure overpays, while a wrong or unindexed percentage underpays; either way the error then flows through overtime, public holiday rates and the leave loading calculated on that base.
