What the Nurses Award covers

The Nurses Award 2020 (MA000034) is the modern award that sets minimum pay and conditions for nurses and nursing support staff across Australia. It covers registered nurses, enrolled nurses, nurse practitioners and assistants in nursing working in settings from public and private hospitals to aged care, medical practices, community health and other clinical environments. Because nursing is built around rotating shifts, on-call and recall, and weekend and overnight cover, this award carries a detailed layer of shift loadings and penalties on top of its classification rates, making it one of the more involved awards to pay accurately.

How pay is structured

MA000034 sets minimum rates against nursing classifications, principally assistants in nursing, enrolled nurses, registered nurses and nurse practitioners, with registered nurses progressing through pay points and grades that reflect experience, qualifications and responsibility. You classify each nurse by their registration, role and pay point, then pay no less than the relevant minimum. Full-time nurses work an average of 38 ordinary hours a week, often rostered over a cycle; part-timers work agreed lesser hours; and casuals are paid by the hour. Minimum rates are reviewed every year in the Annual Wage Review and rise from the first full pay period on or after 1 July; the 2026 review added 4.75% to award minimums. Penalties & loadings

On top of the minimum rate, MA000034 layers afternoon and night shift loadings, Saturday and Sunday penalties, public holiday rates, overtime tiers and on-call and recall provisions. Shift loadings depend on when a shift falls and stack with weekend and public holiday penalties on a round-the-clock roster. As a general guide across awards, casual loading is commonly 25%, weekend penalties run around 25% on Saturday and 50% on Sunday, public holidays can reach up to 150%, and annual leave loading is 17.5% (nurses may instead receive the higher of leave loading or the shift penalties they would have worked). The award also carries allowances such as on-call, uniform or clothing, laundry, meal, vehicle and travelling or accommodation allowances. Common Nurses Award compliance traps

Classifying registered nurses at the wrong pay point

Registered nurses progress through pay points and grades tied to experience and responsibility, and an enrolled nurse, assistant in nursing and registered nurse are paid on different scales entirely. Holding a nurse at an entry pay point when they have progressed, or confusing the streams, creates underpayments that accumulate. Classify by registration, role and the correct pay point, and check the current rate on the Fair Work source.

Paying a flat rate and missing stacked shift and weekend penalties

Afternoon and night shift loadings depend on when the shift falls and apply in addition to Saturday, Sunday and public holiday penalties, so an overnight weekend shift can combine several elements. Paying a single flat hourly rate for evening, overnight and weekend nursing is a common and costly error. Map each shift's timing and day, then confirm the correct loadings against Fair Work.

Paying flat leave loading instead of the higher amount

Because nurses work shift penalties, MA000034 generally entitles them to the higher of annual leave loading or the shift penalties they would have earned during the leave. Defaulting every nurse to the flat loading, and ignoring the forgone-penalties comparison, underpays shift workers on leave. Run the higher-of calculation for each case and confirm the rule on the Fair Work source.

Mishandling on-call, recall and minimum break entitlements

Nurses who are on call, then recalled to work, attract specific allowances and payments, and the award provides minimum breaks between shifts and after a recall. Paying only an on-call allowance and ignoring the recall payment, or rostering insufficient rest between shifts, breaches the award.
